Welcome to StudioFlows. These Terms of Service ("Terms") govern your use of the StudioFlows platform, website, and services (collectively, the "Service") operated by MHamiltonVisuals LLC ("we," "us," or "our").

By creating an account or using StudioFlows, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Description of Service

StudioFlows provides tools for photographers and creative professionals to:

Schedule and publish social media content across multiple platforms
Track image usage across the web
Manage file deliveries to clients
Research and manage client/lead information
Delegate account access to team members

2. Account Registration

To use StudioFlows, you must:

Be at least 18 years old
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

3. Subscription and Payment

StudioFlows offers paid subscription plans with various features. By subscribing:

You authorize us to charge your payment method on a recurring basis
Subscriptions automatically renew unless cancelled before the renewal date
You can cancel your subscription at any time through your account settings
Cancellation takes effect at the end of your current billing period

Refund Policy: All sales are final. We do not provide refunds for subscription payments. When you cancel, you retain access until the end of your current billing period.

4. Acceptable Use

You agree NOT to use StudioFlows to:

Violate any laws or regulations
Infringe on intellectual property rights of others
Post content that is illegal, harmful, threatening, abusive, or hateful
Spam, harass, or send unsolicited communications
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Use automated systems to access the Service without permission
Resell or redistribute the Service without authorization

5. Third-Party Services

StudioFlows integrates with third-party services including social media platforms (Instagram, TikTok, LinkedIn, Facebook, YouTube, X/Twitter, Threads, Pinterest, Bluesky, Google Business, Reddit), payment processors (Stripe), and others.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

6. Content Ownership

Your Content: You retain ownership of all content you upload to StudioFlows. By uploading content, you grant us a limited license to store, process, and transmit your content solely to provide the Service.

Our Content: StudioFlows and its original content, features, and functionality are owned by MHamiltonVisuals LLC and are protected by copyright, trademark, and other intellectual property laws.

7. Team Delegation

If you invite team members to access your account:

You are responsible for their actions taken on your behalf
You control what permissions they have
You can revoke access at any time
Team members must agree to these Terms

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not guarantee that social media posts will be published successfully, as this depends on third-party platform availability and policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MHAMILTON VISUALS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MHamiltonVisuals LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

Your right to use the Service ceases immediately
We may delete your data after a reasonable period
Provisions that should survive termination will remain in effect

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of StudioFlows after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.
